Section 377




You must be wondering what I am talking about all of a sudden straight from love affairs now I am trying my hand at the legal affairs of our country. Well I’m sure many of us are aware of this act passed by the honorable British government in the year 1863 which says……

“Whoever voluntarily has carnal intercourse against the order of nature with any man, woman or animal, shall be punished with [imprisonment for life], or with imprisonment of either description for term which may extend to ten years, and shall also be liable to fine.
Explanation. -Penetration is sufficient to constitute the carnal intercourse necessary to the offence described in this section.”
Going by this law the Homosexuals are subject to the above penalty because unfortunately in India we cannot have our own sexual preferences and if we have them we are penalized for that and hey don’t you forget that India is a democratic country where we have all kinds of rights but our sexual rights and if you are a homosexual in India then god help you!!!!!
But as far as my knowledge and many research goes there are millions of “heterosexuals” who indulge in anal sex on a regular basis but then we never hear that they have been heavily penalized even to the extent of death for that….well if that would be the case then I’m sure most of us would have been dead or in prison by now….
India before the invasion of our demi gods, the Britishers, had vy liberated idea about sex, and come on we all know about the Khajuraho temples, The Kama Sutra (check out the one at crosswords), The Manuskriti, The Upanishads; all of these texts have the mention and glad acceptance of homosexuals but then thanks to the British government they were really good with their manipulating powers. But the irony lies here that in 2005, December same sex marriage has been legalized in the United Kingdom. So the law makers have amended the law but the liberal ones on whom the law had been imposed have internalized it now.
This issue has stirred me because this was the topic of my Public Relation presentation and after getting to know about all this I seriously feel that its high time we should do something. There are so many people I know who are homosexuals and its their way of life, they are biologically this way and they cannot help that. We cannot penalize them for that, this is heights of brutality and the I think educated people like us should do something about it but the saddest part is that the so called “straight” people like us only corner them when it comes to personal experience or confrontation. We ridicule them, mock them, laugh about them and also the word “GAY” is a very frequently used slang for the men folks “ Hey wearing a pink shirt is so gay” statements like this can be heard quite often these days. But I think with time we all have learnt to accept a lot of unjustified things in this world and this is something which is completely justified and its about many peoples life, if not love them we shouldn’t condemn them as well. They are normal people like us just that they prefer their same sex when it comes to love and making out, ( if that helps).

i agree with ur point but only when it concerns that the law doesn't hold when heterosexuals have anal sex...
otherwise, i am against your motion...

next you will be shouting to make prostitution, pornography and narcotics legal in this country...why? India is a democracy for heaven's sake.

and indian culture is not all about some promiscuous people who adorn the walls of ajanta or ellora caves, or the kamasutra(which doesn't only encompass sex, but is an entire guide to live a happily married life) sexual positions in the kamasutra have been glorified by the modernists. It holds information about how the household duties should be shared and other things pertaining to marriage also. And the kamasutra, is pretty conservative in its nature, women can only have intercourse with people from the same caste or they are considered to be "fallen" and rejected from the society. Also it says that widows(vidhvas) can never share her bed with another man again.
So let's follow the kamasutra back into the dark ages shall we?

this is one irritating habit about propaganda spreaders, bringing up pieces of our culture they dont really understand or have never felt the need to really research the topic...

well if you didnt know sex is just anather nessecity of human beings like eating and shitting. Moreover monogamy is a very new concept created human being are born polygamous, for reference go check the ethnographic books for reference...

And as far as prostitution is concerned it should have been legalized long back and pornography is not legalized but does that make any difference still 10 year old to 80 year old everyone watches it...so it might as well get legalized....like san fransisco...

i agree madam but what reference does the first paragraph have to the topic being discussed?

legalizing prostitution would be promoting sex as a trade and polygamy, consequently...and madam if you have noticed the ads on tvs...there is this menace called AIDS which is plaguing the society today...polygamy would lead to higher chances of contracting HIV...which is if you didnt know, a fatal disease which gifts a person with a slow and painful death...so three cheers for legalizing prostitution and polygamy...let's drink to it

and pornography is legal all over the united states not just in san francisco...they have a different culture than ours...and are fighting with a newer menace now child pornography, let's legalize that too....savvy?

well sir i hope u have heard of a concept called condom and if prostitution will be legalized only then can prostitutes act professional and demand for condoms which they cant now. And that would reduce the chances of AIDS to a great extent dont u think so?

legalizing prostitution will cause only one change to the society...prostitutes will have to pay taxes...since you seem to so in favour of these people...maybe you should be concerned about their monetary interests as well? and hope they don't have to add a service tax and education cess to their bill? because prostitution already exists...legalizing it wouldn't make any societal changes

i donot understand why is this topic such a fav issue in this world..isnt it plain and simple that law of nature is something which is make it unnatural for a person to be homosexual. ny one before commenting on this post just just imagine your own mom or dad as one and then concider your own self.

if all the men turns gay and all the women lesbians tommorow then i guess after 100 years we wont have a human race and the earth will be ruled by simians..

I find it odd that whenever the topic of "sex" comes up with reference to this country, the kamasutra always manages to come up...one way or the another.

I agree with "the rain maker" that we cannot legalize certain practices in this society...we as indians tend not to be very accepting in terms of other people's behavior...or the social change that it might bring. On the other hand, the number or cases of "open marriage"..."live in relationships" etc..that have come up in recent times shows that this society is liberal...in its own weird way.

But i agree with the fact that homosexuality should be legalized. If livein relations can be given a judicial backing, then why not same sex marriages? If a woman gets raped, the law is pretty clear on its course of action...but what if a man gets raped...by another man. What happens then? Are they put under trail in the same manner as the rest?

But we must realize...we are India. Not USA...not the British. We as indians have our own culture and traditions...and its these characteristics that make us who we are. People out there die to know where we get our morals and ethics from...how do we manage to live a long and happy married life.

Legalizing homosexuality isnt a matter of passing a bill....its an effort to remove the stigma and discrimination against those who are different...or those who chose to be. Look at the condition of transexuals in india...dancing and singing for a life?

Why can't people just "live and let live?"

Now sth for Rahul who really pissed me off .How can u say that homosexuality is abnormal and that stupid rehab thing.Its scientific that homos r normal and why dont u guys allow them to practise wateva they want.Why do they have to be looked down upon??Why they have to be a butt of every laughter ?just bcoz they have a different sexual orientation.U talked about the law of nature which has been made by the majority just to comfort them.atleast so in the case of homosexuality.Believe in the policy of live and let live and not interfere in others lives.I just wanna say that lets not discriminate against such people else there wont b any difference b/w us and the fascists who considered homos as impure.

I apologize but i shall not turn this "comment" column as a place of fighting. As for ur imaginative thinking where we have 100% gays and 100% lesbians....don't exaggerate! that's exactly why such topics are so difficult to discuss...because people always turn the "discussion" into an "argument". Gays and lesbians are a minority...they might be so due to their choices or maybe its in their genes...we shall never be sure. So what if these people are different? so are albinos. Homosexuality is not a disease...You can't catch "homosexuality" by sitting next to the person and breathing the same air as them...its not infectious! its just one of the various traits that a human populations shows. Diversity my friend...THAT is a law of nature! nature does not make everyone and everything perfect! If it did...we would've never evolved to where we are!
